Are the considerations relating
to confidentiality different
when one party is a state?
We asked respondents whether the
considerations regarding confidentiality are
different when dealing with a state party: 37%
said yes (although a further 37% said they did
not know). We received a broad range of
responses: some respondents believe that
states may seek greater confidentiality (on the
basis of state security and similar grounds),
whereas others think that states may seek to
breach confidentiality due to their disclosure
obligations (e.g. freedom of information). Some
respondents also noted that there is usually
greater media interest in matters involving
states and greater risk of leaks.
